Insurance Authority’s e-Learning system
保險業監管局之電子學習系統

The following terms and conditions ("Terms and Conditions") shall apply to the use of the Insurance Authority’s e-learning system (“the System”). For the avoidance of doubt, “User" in the following paragraphs means a person who has registered a username and password with the Insurance Authority to use the System.

以下條款及條件適用於保險業監管局之電子學習系統(“該系統”)。為避免疑義，以下段落中的“用戶”是指已向保險業監管局登記用戶名稱及密碼以使用該系統之人士。

1. The User shall be responsible for all acts and things done during the use of the System.
   用戶應對在使用該系統過程中所作出的所有行為及事宜承擔責任。
2. The username and password are strictly confidential to the User only and must remain in the User’s possession and control, and should not be disclosed to any other person. In particular, such username and password must not be given or surrendered to any other person for completing e-learning courses available in the System on behalf of the User.
   用戶名稱及密碼須絕對保密，僅限用戶自己使用，並須由用戶管有及控制，且不得向任何其他人士披露。特別是，有關用戶名稱及密碼不得提供或交付予任何其他人士用於代表該用戶完成系統上的電子學習課程。
3. When accessing and using the System, the User shall not:
   於進入及使用該系統時，用戶不得：
1. interfere with, damage, misuse, disrupt or attempt to gain unauthorized access to the System or data used to operate the System, or any part thereof.
   不得干預、損害、濫用、破壞或企圖在未經授權的情況下進入該系統或用於操作該系統的資料或當中任何部分。
2. transmit any data or any material that contains any harmful programmes, including but not limited to viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware and adware or similar computer code that could adversely affect the operation of any computer software or hardware of the System, or any part thereof.
   不得傳送含有任何有害程式，包括但不限於可能會對該系統的任何電腦軟件或硬件或當中任何部分的運作造成不利影響的病毒、特洛伊木馬、蠕蟲、定時炸彈、鍵盤監聽、間諜軟件及廣告軟體或類似的電腦代碼。
4. The User must not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database. The User may use the content from the System only for personal and non-commercial use.
   用戶不得出售或要約出售任何內容，或允許第三方訪問，或使用內容構建任何類型的資料庫。用戶只能將該系統中的內容用於個人和非商業用途。
5. The Insurance Authority shall not accept any liabilities, obligations or responsibilities for any losses (including but not limited to, loss of profit, loss of opportunity, loss of business, or any consequential loss), damages, costs or expenses howsoever caused or incurred, whether arising directly or indirectly from the use of or inability to use the System (or any part thereof).
   對因使用或無法使用該系統（或其任何部分）的任何損失（包括但不限於利潤損失、機會損失、業務損失或任何後果損失）、損害、費用或開支，保險業監管局概不承擔任何法律責任、義務或責任。
6. The Insurance Authority may in its sole discretion terminate or suspend the availability of certain or all functions of the System at any time by without prior notice to the User.
   保險業監管局有權在無須事先通知的情況下決定隨時終止或暫停提供該系統的若干或全部功能。
7. The Insurance Authority may modify these Terms and Conditions from time to time in its sole discretion without giving any reason and/or prior notice to the User.
   保險業監管局有權決定不時修訂該等條款及條件，而無須向用戶提供任何理由及／或作出事先通知。
8. If there is any inconsistency or conflict between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.
   該等條款及條件的中英文版本如有任何歧義或抵觸，概以英文版本為準。
