Personal Information Collection Statement (“PICS”)
收集個人資料聲明

This PICS is made by the Insurance Authority (“IA”) to comply with the notification requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (the “PDPO”). You are advised to read it carefully as it sets out the policies and practices of the IA with regard to your personal data (as defined in the PDPO), the purposes for which the IA may collect and use your personal data and the persons to whom your personal data may be transferred.

為遵從《個人資料（私隱）條例》（第 486 章）（簡稱「《私隱條例》」）的通知規定，保險業監管局（「保監局」）制定本《收集個人資料聲明》。本聲明載述保監局就有關你個人資料（定義見《私隱條例》）的政策及常規、保監局收集和使用你個人資料的目的，以及可獲轉移你個人資料的人士，謹請細閱。

Purpose of Collection 收集目的

The personal data provided by you may be used and held by the IA for one or more of the following purposes:
保監局可就下列其中一個或多個目的，使用並持有你所提供的個人資料：

  1. to administer and/or enforce the provisions of any relevant ordinances (including the Insurance Ordinance (Cap. 41) (the “Ordinance”)) and any regulations, rules, codes, guidelines and circulars made or promulgated pursuant to the powers vested in the IA as in force at the relevant time and to carry out its functions as a regulator of the insurance industry, including:
    實施及／或執行保監局依據其獲賦予的權力所制定或頒布且於相關時間生效的任何相關條例（包括《保險業條例》（第 41 章）（簡稱「《條例》」））及任何規例、規則、守則、指引及通函的規定，以及履行其作為保險業監管機構的職能，包括：
    1. to administer and operate educational and training activities (including Continuing Professional Development (“CPD”) activities organised by the IA for licensed insurance intermediaries);
      實施及營運教育及培訓活動 (包括由保監局為持牌保險中介人舉辦的持續專業培訓活動) ；
    2. to monitor your compliance with any requirement under all relevant laws, rules, regulations, codes, guidelines and circulars regarding attendance of Qualified CPD activities1;
      監察你有否遵守所有相關法律、規則、規例、守則、指引及通函內就參與合資格持續專業培訓活動的規定；
    3. to continually assess your fitness and properness and your status to remain licensed or approved (as the case may be) under the Ordinance;
      依據《條例》監察你是否繼續持牌或獲批准（視所屬情況而定）的適當人選；
    4. to consider any application(s) under the Ordinance where you may otherwise have a connection;
      依據《條例》考慮你可能在其他方面與之有關的任何申請；
    5. to display and publish personal data on the public registers maintained under the Ordinance (where applicable);
      依據《條例》於所備存的公眾登記冊中展示和發布個人資料（如適用）；
    6. to investigate complaints and handle enquiries;
      調查投訴和處理查詢；
    7. to conduct legal proceedings, inspection, investigations, and taking enforcement or disciplinary actions;
      展開法律訴訟、查察、調查，以及採取執法行動或紀律處分；
  2. to co-operate with and assist any other regulatory body and/or law enforcement body of Hong Kong, or of any place outside Hong Kong, whenever appropriate, and to the extent permitted by the laws of Hong Kong;
    在任何適當的時候，以及在香港法律允許的範圍內，配合並協助香港或香港以外任何地方的任何其他監管機構及／或執法機構；
  3. for any statistical and research purposes; and/or
    用作任何統計及研究用途; 及/或
  4. any other purposes as permitted by the laws of Hong Kong.
    香港法律允許的任何其他目的。

In general, you should provide all relevant information which may allow or facilitate the IA in exercising its powers or carrying out its functions (including processing your registration for CPD activities organised by the IA and monitoring CPD compliance). Failure to provide the requested personal data may result in the IA being unable to exercise its powers or carrying out its functions (including processing your registration for CPD activities organised by the IA and monitoring CPD compliance) and may affect the IA’s assessment of your fitness and properness under the Ordinance.

一般而言，你須按保監局的要求提供所需的個人資料，以便保監局行使其權力或履行其職能（包括處理你就保監局所舉辦的持續專業培訓活動的登記及監察你有否遵守有關持續專業培訓的規定）。若未能提供所需的個人資料，則可能導致保監局無法行使其權力或履行其職能（包括處理你就保監局所舉辦的持續專業培訓活動的登記及監察你有否遵守有關持續專業培訓的規定），並可能影響保監局依據《條例》評核你的適當人選資格。

Transfer/Matching of Personal Data 轉移／核對個人資料

In performing the IA’s functions under the relevant laws and regulations, your personal data held by the IA may, for the abovementioned purposes, be disclosed or transferred to any third parties, including financial regulators in Hong Kong (including but not limited to the Mandatory Provident Fund Schemes Authority, the Securities and Futures Commission and the Hong Kong Monetary Authority), law enforcement agencies, courts, tribunals and committees and/or other local and/or overseas regulatory/government/judicial bodies as permitted and/or required under the laws of Hong Kong, pursuant to any regulatory/supervisory/investigatory assistance arrangements between the IA and other regulators/authorities (within or outside of Hong Kong) or persons appointed or engaged by the IA to assist it in the performance of its functions.

保監局根據相關法律及規例履行職能時，可就上述目的將所持你的個人資料披露或轉移予任何第三方，包括香港的金融監管機構（包括但不限於強制性公積金計劃管理局、證券及期貨事務監察委員會及香港金融管理局）、執法機構、法庭、審裁處及委員會，及／或（在香港法律容許及／或有所規定的情況下）依據保監局與（香港或香港以外的）監管機構或當局之間的任何監管／監督／協助調查安排下的其他本地及／或境外監管機構 ／政府／司法部門或獲保監局委任或委聘協助其履行職能的人士。

Personal data may be used by the IA and/or disclosed or transferred by the IA to the parties listed above for the purposes of comparing, verifying and/or carrying out a matching procedure2 of those data. 保監局可就對有關資料進行比較、核實及／或核對程序1的目的使用個人資料及／或將個人資料披露或轉移予上述各方。

Access to Data 查閱資料

Under the PDPO, you have the right to request access to and/or for correction of your personal data held by the IA. Please complete a “Data Access Request Form” and send it by post to the Data Privacy Officer of the IA at 19/F, 41 Heung Yip Road, Wong Chuk Hang, Hong Kong for processing of your request. The IA has the right to charge a reasonable fee for processing any such request.

根據《私隱條例》，你有權要求查閱及／或更正保監局所持你的個人資料。請填寫「查閱資料要求表格」2，並以郵遞方式寄送至保監局的個人資料私隱主任（地址為香港黃竹坑香葉道41號19樓），以便處理你的要求。保監局有權就處理任何有關要求收取合理的費用。
